Terms of Service
1. Introduction
Welcome to Marinaid. These Terms of Service ("Terms") form a legally binding agreement between you and Polpis LLC ("Marinaid," "we," "us," or "our") and govern your access to and use of the Marinaid mobile application and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility and Accounts
- You must be at least 13 years old (or the minimum legal age in your jurisdiction).
- The Service requires an Apple ID with iCloud enabled. Your account is tied to your Apple ID.
- You are responsible for maintaining the security of your Apple ID and iCloud account.
- You are responsible for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms or applicable law.
3. License to Use the Service
Subject to your compliance with these Terms, Marinaid grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
- Do not copy, sell, or commercially exploit the Service.
- Do not reverse engineer or attempt to extract source code.
- Do not use the Service for unlawful purposes.
4. User Content
You may create, upload, or store content such as recipes, notes, and cooking data ("User Content"). You retain ownership of your User Content.
Your User Content is stored in your private Apple iCloud account via CloudKit and on your device in a local database. By using the Service, you grant Marinaid a limited license to process and display your User Content solely to operate and improve the Service.
Marinaid does not make User Content public by default and does not operate a public content-sharing platform.
You are responsible for ensuring that you have the rights to any User Content you upload.
5. Subscriptions
Marinaid is offered as a subscription-based service. Subscriptions are purchased and managed through the Apple App Store.
- Pricing, renewal terms, and cancellation details are disclosed at purchase.
- Refunds are governed by Apple’s policies.
- Subscriptions are for personal, non-commercial use only.
6. Payment and Cancellation
Subscriptions renew automatically unless cancelled through your App Store account settings. Cancellation takes effect at the end of the current billing period.
Marinaid does not process payments directly and does not store payment details.
7. Marinaid Intellectual Property
All rights, title, and interest in the Service, including software, design, and branding (excluding User Content), are owned by Marinaid or its licensors.
You may not use Marinaid trademarks or branding without prior written permission.
8. Feedback
If you provide feedback or suggestions, you grant Marinaid the right to use that feedback to improve the Service without obligation or compensation.
9. Third-Party Services
The Service integrates with the following third-party services:
- Apple iCloud (CloudKit) — cloud storage and cross-device sync, governed by Apple's terms and privacy policy.
- RevenueCat — subscription management and purchase verification, governed by RevenueCat's terms and privacy policy.
- Unsplash — recipe photo search, governed by Unsplash's terms and license.
Your use of these third-party services is subject to their respective terms and policies. Marinaid is not responsible for third-party content, services, or practices.
10. Account Termination
You may delete your account at any time through the App or by contacting support. We may suspend or terminate access to the Service if you violate these Terms.
Upon termination, your right to use the Service will cease. Data stored in your iCloud account is managed by Apple and subject to your iCloud storage settings.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, Marinaid shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which Polpis LLC is organized, without regard to conflict-of-law principles.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or other appropriate means.
